The Client is hiring the Business for their time and expertise. This agreement is between the Client, whose name is listed on this online booking, and yxphotos llc, here on out referred to as the Photographer or yxphotos.

A. Photo Gallery
 
A link will be emailed to the client within 7-10 business days after their photoshoot session, this link will give the client access to their curated digital gallery. This gallery is active for 30 days and includes ready to download jpeg files (Copyright & Watermark applied) . The client will make sure to download all files they wish to keep before the gallery expires. the photographer is not responsible for storing or providing these files after the gallery expires.

B1.High-end Edits

The client will pick (heart) the photos they wish to have edited on their gallery within two weeks from receiving the gallery and advice their photographer once they have done so. full balance must be paid before any photos are edited. 7 day average turnaround time , if edits are needed by a certain date ask your photographer about expedited services. Edits do not include any watermarks.

B2. Retouched photos

Retouched photos are selected by the photographer to be lightly edited ( blemish removal and color correction ) then curated into an online gallery for the client to enjoy. No photo proofs are included in the gallery & the edits do not include any watermarks.

C. Creative license

Photo galleries are curated at the photographer's discretion and not all photos taken in the photography session will be delivered. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. Any special request or modification to the edits may result in additional fees.

D. Client usage

The Client shall only use the digital files and prints in accordance with the permissions within this agreement. The Client’s files and prints are for personal use only and shall not be submitted to contests, reproduced for commercial, sale use or authorize any reproductions by parties other than the Photographer. A photo release form must be purchased from the photographer if the client wishes to use the files for any commercial use or to print from a 3rd party.

E. Copyright & Reproduction

The Photographer owns the copyright to all images & video created/taken with the exclusive rights to make reproductions, edits or modifications. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests, art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.

F. Indemnification

The photographer will not be held responsible for any injuries to the client(s) or damages to their belongings during the course of the photography session. This also applies to any immediate events in the surrounding area, regardless of location. Client(s) will be responsible for themselves, and anyone they choose to accompany them on their photoshoot. In addition, any damages made to any photography equipment, location, provided props, or photographer's belongings; caused by those who accompanied the client or the client themselves will be covered at full cost by the client.

G. Modification

This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the State the services are provided.

H. Payments and pricing

The Client agrees to pay invoice(s) and balances due by the due date(s) specified. Unpaid or overdue invoices may result in termination of the Project (photos/videos deleted). All charges due must be paid before the client's gallery is sent out. The client is responsible for any fees due at the location they choose for their photo session (studio fees are included in studio package price), including but not limited to parking and entrance for the photographer. Any additional goods or services not included in this contract will be sold at then-current rates. Photographer makes no pricing guarantees outside of the terms of this contract, and the Client acknowledges that prices for additional goods or services are subject to change suddenly and without notice.

I. Failure to perform

If the Photographer is unable to perform this agreement due to illness, emergency, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.

J. Refunds & cancellations

Retainers/deposits are non refundable. Cancellations must be submitted 3 days before your photoshoot appointment to be able to receive 75% of your retainer/deposit as a credit towards another photoshoot ( must be booked within 30 days before credit expires )

K. Re-shoots

Re-shoots are determined at the discretion of the photographer. Poor choice of clothing, make-up, hair, accessories, or weather-related issues does not warrant a re-shoot ( the photographer will contact you the morning or the day before your photoshoot to confirm weather conditions and give you the option to reschedule )

L. Rescheduling & late arrivals

The client may reschedule their session one time, must submit request at-least 3 days prior to their photoshoot session to avoid rescheduling fee ( 25% of total package price ). The rescheduled session must take place within 60 days. The photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or any circumstances beyond their control. Photo session starts at the time posted on your booking. First and last 5 minutes of the photo session is for set up and wrap up. Plan to arrive 10 minutes early to be photo ready on time. I don't charge Late fees, arriving late will cut into your photoshoot time. 31 minutes late the photoshoot will need to be rescheduled ( full balance plus rescheduling fee must be paid in full to be able to reschedule.)

M. Travel fee

Travel fee may apply when photoshoot location is outside Broward County Florida.
